The Immigration Act of 1990 creates the fifth category Investor Program, known as EB-5.

To encourage foreign EB-5 investment in the U.S. economy, Congress created an EB-5 program in 1993. Congress permitted the U.S. immigration agency to designate qualified applicants as Regional Centers. A Regional Center is a private enterprise or a regional governmental agency with a targeted industry investment program within a defined geographic region. Circa 90% of immigration investment is conducted through USCIS approved Regional Centers.

Approval rates are high, with 82% of investor applications approved by USCIS in 2013.

As a result, the total investment in U.S. businesses has been substantial.
