Your EB-5 green card has a two year condition when initially granted.

It is vital that your attorney is able to demonstrate your investment has been sustained throughout the relevant period & that the 10 jobs have been created.

Be proactive. Don’t leave it too late to ensure the two year condition can be removed. You attorney should be working with you to monitor the job creation process and EB-5 compliance throughout the whole period.

Within 90 days of the 2-year conditional green card’s expiration date, the investor must file Form I-829 to request removal of the two year condition. Spouses & children of the EB-5 immigrant investor who are also conditional permanent residents may be included in the same application.

Failure to file form I-829 can result in termination of the conditional resident status and deportation proceedings.

Once the two year condition have been removed, an unconditional green card is granted for permanent resident status in the United States. After four years and nine months (90 days before the fifth anniversary of your permanent resident status) of permanent residency (including the two conditional years), an investor may apply for U.S. citizenship.
